Terms and Conditions

Welcome to Pontus.fm. These terms are a contract between you and UBQ Limited ("we", "us"), a company registered in the United Kingdom. By creating an account or using Pontus.fm (the "Service"), you agree to these terms. If you don't agree, please don't use the Service.
We've tried to keep this short and readable. If anything's unclear, email us at support@pontus.fm.
1. What Pontus.fm does
Pontus.fm lets you create polls, collect answers, and (in future) connect those polls to podcasts you're associated with. We may add, change, or remove features over time.
2. Your account
You need an account to use most of the Service. You can sign in with Google. You're responsible for what happens under your account, so keep your sign-in secure and don't share access. You must be at least 16 years old to use Pontus.fm.
You promise that the information you give us is accurate, and that you'll keep it up to date.
3. Credits and payment
The Service runs on credits:
- New accounts get 5 free credits to try things out.
- After that, you can buy credits in bundles. These are one-time purchases — there's no subscription.
- Prices are shown at checkout. Payments are processed by our payment provider (Stripe); we don't store your card details ourselves.
- Credits don't expire unless we tell you otherwise in writing.
- Credits have no cash value, can't be transferred to another account, and can't be exchanged for money.
Refunds. Because credits are digital and usable immediately, your statutory 14-day right to cancel under UK consumer law ends as soon as you start using credits from a bundle. If you haven't used any credits from a purchase, email us within 14 days and we'll refund you. Outside of that, we'll consider refund requests case by case but aren't obliged to give one.
If a payment fails, is reversed, or is charged back, we may suspend your account until it's resolved.
4. Acceptable use
Don't use Pontus.fm to:
- Break the law, or help anyone else break it
- Post or collect content that's illegal, hateful, harassing, defamatory, or infringes someone's rights
- Send spam, scrape the Service, or interfere with how it works
- Try to break, reverse-engineer, or get unauthorised access to the Service
- Pretend to be someone you're not, or mislead people about who's running a poll
If you break these rules, we can suspend or close your account and keep any unused credits.
5. Your content
You own the polls, questions, answers, and other content you create ("Your Content"). By using the Service, you give us permission to host, store, copy, and display Your Content as needed to run the Service for you. That's it — we don't claim ownership and we won't sell your content.
You're responsible for Your Content and for making sure you have the right to share it.
6. Our content
The Service itself — the software, design, brand, and everything we've built — belongs to us. You can use it as a customer, but you don't get any other rights to it.
7. Availability
We try to keep the Service running smoothly, but we don't promise it'll be available all the time or completely error-free. We may need to take it down for maintenance or updates, and we'll try to give notice when we can.
8. Closing your account
You can delete your account at any time from your settings, or by emailing us. We can suspend or close your account if you break these terms, if we're required to by law, or if we stop offering the Service.
If your account is closed because you broke these terms, you won't get a refund for unused credits. If we close the Service entirely, we'll refund unused credits from purchases made in the previous 12 months.
9. Liability
Nothing in these terms limits our liability for things the law doesn't allow us to limit — for example, fraud or death/personal injury caused by our negligence.
Subject to that:
- We provide the Service "as is" and don't make any specific guarantees about it.
- We're not liable for indirect or consequential losses, lost profits, or lost data.
- Our total liability to you in any 12-month period is limited to the amount you paid us in that period, or £100 if you haven't paid us anything.
10. Changes to these terms
We may update these terms from time to time. If we make significant changes, we'll let you know by email or through the Service before they take effect. If you keep using Pontus.fm after that, you're agreeing to the updated terms.
11. Law and disputes
These terms are governed by the laws of England and Wales. Any disputes will be handled by the courts of England and Wales, except that if you're a consumer living elsewhere in the UK or the EU, you can also bring a claim in the courts of your home country.
